TERMS AND CONDITIONS, DISCLAIMERS, AND REFUND POLICY

These Terms and Conditions ("Terms") govern your access to and use of the products,
courses, coaching, video analysis, digital content, and any related services (together,
the "Services") supplied by Surf Precision Academy ("SPA", "we", "us", "our"). By
purchasing, accessing, or using any of the Services, or by ticking the acceptance box at
checkout, you ("you", "the Client", "the Participant") confirm that you have read,
understood, and agree to be bound by these Terms. If you do not agree, do not purchase or
use the Services.
1. NATURE OF THE SERVICES
1.1 SPA provides online and remote surf coaching, video analysis, digital courses, a
physical book, and higher level one to one coaching programs. The Services are
educational and instructional in nature.
1.2 Video Analysis consists of a frame by frame breakdown video with voiceover. It does
not include written reports unless expressly stated at the point of sale.
1.3 Coaching is delivered remotely. SPA is not physically present when you surf, does not
supervise your surfing, and has no control over the conditions, location, equipment, or
manner in which you choose to surf.
1.4 You remain solely responsible for deciding when, where, and whether to enter the
water and for surfing within your own ability and the prevailing conditions.
2. RISK WARNING AND ASSUMPTION OF RISK
2.1 RISK WARNING: Surfing is a dangerous recreational activity that carries a significant
and inherent risk of serious personal injury, permanent disability, drowning, and death.
Risks include but are not limited to waves, currents, rocks, reefs, the sea floor,
sandbars, marine life, collisions with other surfers or objects, your own surfboard, fins,
leash, cold, sun, fatigue, misjudgement, and the actions of others. These risks cannot be
eliminated.
2.2 You acknowledge that you understand these risks and that you voluntarily and
knowingly assume all risk of harm arising from surfing and from acting on any instruction,
drill, advice, or content provided by SPA.
2.3 You confirm that you choose to participate in surfing and to use the Services at your
own risk.
3. MEDICAL FITNESS AND PARTICIPANT RESPONSIBILITY
3.1 You confirm that you are medically fit to surf and to undertake any physical activity
associated with the Services.
3.2 You are responsible for obtaining your own medical or professional advice before
acting on any drill, exercise, training, or coaching recommendation. SPA does not provide
medical, physiotherapy, or health advice.
3.3 You are responsible for ensuring your equipment is safe and suitable, for assessing
conditions before each surf, and for surfing within your competence.
4. NO GUARANTEE OF RESULTS
4.1 The Services are designed to improve surfing knowledge and skill, but results depend
on many factors outside SPA's control, including your ability, effort, consistency,
conditions, and time in the water.
4.2 SPA makes no promise, representation, or guarantee of any specific outcome, skill
level, result, or performance. Any examples of client results are illustrative and are not
a promise that you will achieve the same.
5. RELEASE, WAIVER, AND LIMITATION OF LIABILITY
5.1 To the maximum extent permitted by law, you release and discharge SPA, its owner,
employees, contractors, and agents from all claims, demands, losses, damages, costs, and
liabilities of any kind (including personal injury, death, and property damage) arising
directly or indirectly from your surfing, your use of the Services, or your reliance on
any content, drill, or advice provided by SPA, whether caused by negligence or otherwise.
5.2 To the maximum extent permitted by law, SPA's total liability arising out of or in
connection with the Services is limited to the amount you paid for the specific Service
giving rise to the claim.
5.3 To the maximum extent permitted by law, SPA is not liable for any indirect,
consequential, incidental, or special loss, or for loss of profit, opportunity, or data.
5.4 AUSTRALIAN CONSUMER LAW: Nothing in these Terms excludes, restricts, or modifies any
consumer guarantee, right, or remedy that you have under the Australian Consumer Law or
any other law that cannot lawfully be excluded. Where liability cannot be excluded but can
be limited, SPA's liability is limited, at SPA's option, to resupplying the relevant
Service or paying the cost of resupply.
6. PAYMENT AND REFUND POLICY
6.1 All prices are in Australian Dollars unless stated otherwise. Payment is required in
full before the Service is delivered, unless a payment plan is agreed in writing.
6.2 GENERAL POSITION: All sales are final and no refunds are given, except as set out in
clause 6.3 or as required by the Australian Consumer Law.
6.3 EXCEPTIONS. A refund may be granted only in the following circumstances:
(a) INJURY. You suffer an injury that a qualified medical practitioner certifies, in a
written and dated medical certificate, prevents you from surfing for a period of more
than three (3) months. In this case a refund may be given for coaching or Services not
yet delivered. Services already delivered are not refundable. The certificate must be
provided to SPA before a refund is assessed.
(b) NON DELIVERY. SPA fails to deliver the coaching or Service to you at all. This
exception does not apply where the Service has been delivered in whole or in part, or
where you have failed to provide the materials, footage, availability, or information
reasonably required for SPA to deliver the Service.
6.4 Refunds are not given for change of mind, lack of time, failure to complete a course
or program, dissatisfaction with your own progress, or failure to act on the coaching
provided.
6.5 Digital products, downloads, and course access are supplied immediately on purchase.
To the extent permitted by law, once accessed they are not refundable.
6.6 CHARGEBACKS. Initiating a chargeback or payment dispute in breach of these Terms is a
breach of contract. SPA reserves the right to dispute unjustified chargebacks and to
suspend or terminate access pending resolution.
6.7 To request a refund under clause 6.3, contact SPA in writing at the email in clause 15
with your order details and supporting evidence.
7. FILMER OPTION (THIRD PARTY FILMING SERVICE)
7.1 The filmer add on, where available, is an optional service in which an independent
filmer meets you at an agreed surf break and films your surfing for a session of up to one
(1) hour.
7.2 The filmer's obligation is limited to attending and filming for up to one hour. The
filmer is not obliged to remain, wait, or continue filming beyond the one hour session for
any reason, including conditions, crowds, your late arrival, or lack of waves.
7.3 The filmer add on is subject to availability as our filmer network grows. SPA does not
guarantee that a filmer is available at your location, break, date, or time.
7.4 Filmers are independent contractors, not employees or agents of SPA. SPA does not
supervise, direct, or control the filmer at the session. To the maximum extent permitted
by law, SPA is not liable for the acts, omissions, conduct, timeliness, equipment,
reliability, or quality of any filmer.
7.5 You are responsible for your own safety, decisions, and conduct at all times during
filming, including arranging to meet the filmer, travelling to and from the break, and
your surfing. Meeting and surfing at a public break is at your own risk.
7.6 SPA does not guarantee the quantity, quality, angle, or usability of any footage.
Footage may be affected by conditions, light, distance, positioning, crowds, or equipment,
and no waves or usable clips may be captured within the session. No refund is given for
footage that is limited by these factors.
7.7 The filmer add on fee covers the filming session only and is separate from any
coaching or analysis fee.
7.8 SCHEDULING AND CONDITIONS. It is your responsibility to organise the day and time of
the filming session and to select a window when surfing conditions are appropriate. This
does not imply, and SPA does not guarantee, perfect or high quality conditions. You accept that conditions may not be perfect or high quality. A reschedule is not available where the conditions on the day are reasonable to surf, even if they are not ideal. Reschedules, where offered at all, are subject to filmer availability.
8. FOOTAGE, MEDIA, AND MARKETING
8.1 You may be required to supply your own footage or clips for video analysis and
coaching. Clips are collected after payment, not before.
8.2 You grant SPA a licence to view, edit, and annotate any footage you supply for the
purpose of delivering the Services.
8.3 SPA may use footage, before and after results, testimonials, and outcomes for
marketing and promotional purposes. If you do not wish your footage or results to be used
in marketing, you must notify SPA in writing before or at the time of purchase, and SPA
will honour that request going forward.
9. INTELLECTUAL PROPERTY AND LICENCE
9.1 All courses, videos, analysis, written materials, the book, drills, methods, and
content are the intellectual property of SPA and are protected by law.
9.2 On purchase you receive a personal, non transferable, non exclusive licence to access
and use the content for your own personal use only.
9.3 You must not copy, reproduce, share, resell, distribute, publish, screen record, or
give others access to any SPA content or login. Breach may result in immediate termination
of access without refund and further legal action.
10. ACCEPTABLE USE AND CLIENT CONDUCT
10.1 You agree to interact with SPA and its contractors respectfully and lawfully.
10.2 SPA may suspend or terminate your access to the Services, without refund, if you
breach these Terms, abuse staff or contractors, share content, or act unlawfully.
11. INDEMNITY
To the maximum extent permitted by law, you indemnify SPA and its owner, contractors, and
agents against all claims, losses, damages, costs, and expenses arising from your surfing,
your use of the Services, your breach of these Terms, or your infringement of any third
party rights.
12. THIRD PARTY LINKS AND SERVICES
The Services may reference or link to third party products, platforms, or services. SPA is
not responsible for third party content, conduct, or availability.
13. PRIVACY
SPA handles personal information in accordance with its Privacy Policy and applicable
privacy laws. By using the Services you consent to that handling.
14. GENERAL
14.1 FORCE MAJEURE. SPA is not liable for delay or failure to deliver caused by events
beyond its reasonable control, including illness, injury, weather, natural events,
technology or platform failure, or acts of third parties.
14.2 CHANGES. SPA may update these Terms at any time by posting the updated version. The
version in force at the time of your purchase applies to that purchase.
14.3 SEVERABILITY. If any provision is found to be invalid or unenforceable, it is
severed and the remaining provisions continue in force.
14.4 ENTIRE AGREEMENT. These Terms, together with the specific offer at the point of sale,
form the entire agreement between you and SPA and override any prior representation.
14.5 GOVERNING LAW. These Terms are governed by the laws of New South Wales, Australia,
and you submit to the non exclusive jurisdiction of its courts.
